Colorado county court complaint for replevin, civil theft, and breach of contract. Replevin is used when the complaining party (called a “plaintiff”) has a greater right of ownership than the responding party (“defendant”); civil theft is used when the plaintiff has an absolute right of ownership and the defendant has no right to the pet, but obtained possession of the pet through deception (theft by deception) and/or theft; breach of contract is for situations where the plaintiff and defendant shared custody for a period of time based on a verbal agreement and then defendant unilaterally stopped sharing custody, or where defendant promised to watch the pet for a period of time and then refused to return the pet upon the end of the term agreed upon to watch the pet. All three types of recovery (replevin, civil theft, breach of contract) can be plead simultaneously.
